Manufacturer Warranty Agreement
This Manufacturer Warranty is offered by RolBec Instruments LLC (“Manufacturer”) to the original purchaser (“Purchaser”) of a new “Product”. This warranty covers the Product against defects in materials and workmanship under normal use, subject to the terms and conditions outlined below. The warranty is valid only for Products purchased directly from RolBec Instruments LLC or an authorized dealer, and is non-transferable.
1. Warranty Coverage
- Manufacturer warrants to the original Purchaser that the Product shall be free from defects in materials and workmanship under normal use for a period of two (2) years from the date of original purchase ("Warranty Period").
- This Warranty applies only to Products purchased new from an authorized Manufacturer dealer.
2. What is Covered
- This Warranty covers defects in materials and workmanship that cause the Product to fail to perform in accordance with Manufacturer's specifications.
3. What is Not Covered
This Warranty does not cover the following:
- Damage caused by accident, misuse, abuse, neglect, or improper installation.
- Damage caused by unauthorized modification or repair.
- Normal wear and tear, including but not limited to cosmetic damage, scratches, and deterioration of parts.
- Damage caused by acts of God, such as fire, flood, or earthquake.
- Products with altered or defaced serial numbers.
- Shipping damage (claims must be presented to the carrier).
- Consumable parts, including but not limited to corks, o-rings and other parts that are expected to wear out over time.
- Any product used for commercial or rental purposes.
4. Purchaser's Responsibilities
- The Purchaser must provide a valid proof of purchase (original sales receipt) showing the date of purchase and the name of the authorized dealer.
- The Purchaser is responsible for properly using, maintaining, and storing the Product in accordance with the Manufacturer's instructions.
- The Purchaser must notify the Manufacturer or an authorized service center of any suspected defect within the Warranty Period.
5. Manufacturer's Options
During the Warranty Period, if the Product is determined to be defective, the Manufacturer will, at its sole discretion, either:
- Repair the defective Product at no charge for parts or labor.
- Replace the defective Product with a new or refurbished Product of comparable quality.
6. Limitation of Liability
- THE MANUFACTURER'S LIABILITY UNDER THIS WARRANTY IS LIMITED TO THE REPAIR OR REPLACEMENT OF THE DEFECTIVE PRODUCT AS PROVIDED HEREIN.
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MANUFACTURER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, OR LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH THIS WARRANTY OR THE USE OR INABILITY TO USE THE PRODUCT, EVEN IF THE MANUFACTURER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- THE REMEDIES PROVIDED HEREIN ARE THE PURCHASER'S SOLE AND EXCLUSIVE REMEDIES.
7. Warranty Transfer
This Warranty is non-transferable and applies only to the original Purchaser.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles.
9. Entire Agreement
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the parties.
10. How to Obtain Warranty Service
To obtain warranty service, the Purchaser must:
- Contact the Manufacturer's customer service department at rolbecinstruments@gmail.com to obtain a Return Authorization (RA) number.
- Securely package the Product, including all accessories, and ship it to the Manufacturer or an authorized service center, freight prepaid, along with the proof of purchase and the RA number clearly marked on the package.
- The Purchaser is responsible for all shipping costs to the Manufacturer or authorized service center. The Manufacturer will pay for return shipping of the repaired or replaced Product to the Purchaser, provided the warranty claim is valid.
11. Miscellaneous
* Any repair or replacement under this warranty does not extend the original warranty period. The warranty on the repaired or replaced product is for the remainder of the original warranty period.
* The Manufacturer reserves the right to make changes to this warranty agreement at any time.
